TERMS OF SERVICE & END USER AGREEMENT FOR MECHANIC CONNECT

Welcome to Mechanic Connect, operated by OH-PEL AUTO LIMITED.PLEASE READ THESE TERMS CAREFULLY BEFORE USING MECHANIC CONNECT.

This is a legal agreement between you (“User,” “you,” or “your”) and OH-PEL AUTO LIMITED, trading as Mechanic Connect (“we,” “us,” “our,” or the “Company”). By downloading, installing, accessing, or using the Mechanic Connect mobile applications, websites, and related services (collectively, the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”).

By creating an account or using the Services, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding contract. Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms.

Continued use of our application, website and services mean that you accept all terms and conditions.

1. What Mechanic Connect is

Mechanic Connect is a technology platform that connects vehicle owners and operators (“Customers”) with independent, third-party automotive mechanics and garages (“Service Providers”). Mechanic Connect does not provide automotive repair services.

The platform allows Service Providers to facilitate:

-Repairs & servicing
-Diagnostics
-Roadside assistance
-Spare parts requests (handled only by OH-PEL AUTO LTD)

We are not a mechanical service provider.

· We are not a party to any agreement between a Customer and a Service Provider.

· Service Providers are independent businesses and are not employees, agents, or representatives of OH-PEL AUTO LIMITED.

· We do not guarantee the quality, safety, or legality of any services performed by Service Providers.

2. Who can use the App

You must:

-Be 18 years or older

-Use accurate information

-Create only one account per role

-Keep your login details secure

You may use the app as a:

-Customer

-Mechanic/Garage

-Or both

You must provide accurate, current, and complete information and keep your account information updated.

Account Security:

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3. Account Verification (Mechanics/Garages)

Mechanics/Garages must complete verification before accepting jobs.

Verification may include:

-ID check (view-only; we do not store ID images)

-TRN Number

-Location/garage confirmation

-Business or trade certification

We reserve the right to suspend accounts that fail verification or submit fraudulent information.

4. Quotes, Fees & Payments

4.1 Quotes

All quotes are estimates only and may change after physical inspection or once the full scope of work is known.

4.2 Booking Fee (Customers)

No Platform Fees for Customers:

Customers do not pay any platform or booking fees to Mechanic Connect. Customers pay only the Service Provider’s quoted price.

No booking fee for spare parts requests. All spare parts are processed and fulfilled only by OH-PEL AUTO LIMITED.

4.3 Wallet & Payments

Payments are made inside the app using the in-app wallet or supported payment methods. All payments are processed by third-party payment processors such as PowerTranz. Mechanic Connect does not store full card details.

Customers can:

-Add funds

-Pay for services/parts

-Escrow-Style Payment Release:

-Customer payments are held and are only released to the Service Provider after the Customer confirms that the job is completed.

-Mechanics/Garages receive funds after completion is confirmed.

4.4 Mechanic/Garage Commissions

Commission Model for Service Providers:

Mechanic Connect charges Service Providers a platform commission that is:

  • Subject to a minimum fee of JMD 500 per job
  • Subject to a maximum cap of JMD 25,000 per job
  • Calculated so that the effective percentage decreases as job value increases

Early Partner Discount:

Early Partner garages may receive discounted commission rates for a limited initial period, after which standard rates apply.

Payout Schedule:

Standard payouts to Service Providers are processed twice per week — every Wednesday and Friday.

Early Payout Option:

Service Providers may request a next-business-day payout, which will attract an early withdrawal processing fee disclosed before confirmation.

Authorization:

By using the Services, you authorize us and our pay

This commission is deducted when:

Withdrawing earnings, OR

Bi-weekly(every 2 weeks) scheduled payouts run

4.5 Withdrawals

Free scheduled payouts every 2 weeks

Early withdrawals allowed (small processing fee may apply)

The fee amount is shown before confirming the withdrawal.

5. Parts & OH-PEL AUTO LIMITED

When parts are required, parts sourcing may be facilitated through OH-PEL AUTO LIMITED or its partners. Mechanic Connect does not manufacture or warrant any parts.

6. User Responsibilities

Customers Must:

-Provide accurate job information

-Ensure safe working conditions

-Confirm job completion honestly

-Behave respectfully

-Pay only through the app

Users agree not to bypass the platform for jobs initiated through Mechanic Connect. Jobs conducted outside the platform are not protected by the payment system, dispute process, or records, and may result in suspension or termination.

Mechanics/Garages Must:

-Provide safe, competent service

-Maintain tools and licenses

-Arrive on time

-Provide accurate quotes

-Communicate changes or extra fees

-Avoid off-platform transactions

7. Ratings & Reviews

You may rate your experience after each job.

Fake, abusive, or manipulated ratings may result in account suspension.

8. Prohibited Actions

Users may not:

-Submit false or misleading information

-Engage in fraud or harassment

-Damage vehicles

-Circumvent app payments or solicit off-app jobs

-Reverse engineer the app

-Abuse the wallet or chargeback system

You are solely responsible for any content you upload, including photos, messages, and job descriptions (“User Content”). You grant Mechanic Connect a non-exclusive, royalty-free license to use such content solely for the purpose of providing the Services.

Violations may lead to suspension, termination or legal actions.

9. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED.

MECHANIC CONNECT DOES NOT PROVIDE MECHANICAL SERVICES AND IS NOT RESPONSIBLE FOR THE ACTIONS OR OMISSIONS OF ANY SERVICE PROVIDER.

We do not guarantee:

-Quality of mechanic work

-Service outcome

-Availability of mechanics

-Accuracy of quotes

We are not responsible for:

-Vehicle damage

-Delays or no-shows

-Poor workmanship

-Injury or property loss

-Service disputes

All mechanical work is solely between Customer and Mechanic/Garage.

10. Limitation of Liability

To the maximum extent permitted by law, OH-PEL AUTO LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Services or any services provided by Service Providers.

Our total liability to you for any claim relating to the Services shall not exceed the total fees paid by you to us (if any) in the six (6) months prior to the event giving rise to the claim.

We are not liable for mechanical work or service outcomes.

11. Spare Parts Return Policy 

These rules apply only to spare parts purchased through OH-PEL AUTO LIMITED.

Returns are accepted only for unused, unopened parts in original packaging.

Electrical parts cannot be returned once installed or removed from packaging.

Custom-ordered or special-order parts are non-refundable.

All return requests must be made within 7 days of pickup or delivery.

Refunds are processed only to the in-app wallet after inspection and approval.

OH-PEL AUTO LIMITED reserves the right to refuse returns that show signs of use, damage, or improper handling.

12. Indemnification

You agree to indemnify and hold harmless OH-PEL AUTO LIMITED and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms, or your interaction with any Service Provider or Customer.

 You agree to indemnify OH-PEL AUTO LIMITED from claims arising from:

-Your use of the app

-Mechanical services performed

-Disputes or off-platform activity

-Fraud or misuse

13. Termination

We may suspend or terminate accounts that violate our Terms or safety rules.

You may delete your account anytime under Profile Settings.

14. Dispute Resolution

These Terms are governed by the laws of Jamaica. Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in Kingston, Jamaica, in accordance with the Jamaican Arbitration Act. You agree to resolve disputes individually and waive any right to participate in a class action. No class actions permitted.

15. Changes to Terms

We may update these Terms at any time.

Significant changes will be notified in-app.

Continued use means you accept the updates.
